Oil Companies Lose Federal Court Bid in Minnesota Climate Case

The American Petroleum Institute, Exxon Mobil Corp., and Koch Industries can’t take Minnesota’s climate case to federal court, according to an appellate panel.

Judges from the US Court of Appeals for the Eight Circuit joined other federal circuits on Thursday in tossing an oil and gas appeal for federal jurisdiction in a climate misinformation case.

Minnesota Attorney General Keith Ellison (D) sued the companies in 2019, alleging they knowingly mislead consumers about the climate dangers of producing, selling, and using fossil fuel products. Judges Leonard Steven Grasz, David R. Stras, and Jonathan A. Kobes heard arguments in March 2022.
